Terms of Service

1. Agreement
These Terms of Service (“Terms”) govern your use of the Claim Cal service (“Service”) provided by Hivelight Pty Ltd (ABN XX XXX XXX XXX) (“we”, “us”, “our”). By accessing or using the Service, you agree to these Terms.
2. Service description
Claim Cal provides calculation tools for personal injury claims in Australia, including a damages calculator, economic loss analyser, and settlement tracker. The Service uses regulatory data from public sources (ABS, RBA, NSW Government) to assist with calculations.
3. Not legal advice
Claim Cal is a calculation tool, not a legal advisor. The Service does not provide legal advice. All outputs are calculations based on data you input and publicly available regulatory data. You are responsible for verifying the accuracy and appropriateness of all calculations for your specific matter. We recommend independent verification of all outputs.
4. Accounts and organisations
You must provide accurate information when creating an account. Each user belongs to one organisation. You are responsible for maintaining the security of your account credentials. Organisation administrators are responsible for managing user access.
5. Pricing and payment
Your first 3 cases are free. After that, each case costs $99 (including GST), charged when you create a case. Per-case fees are itemised on your invoice with matter references for disbursement. Payments are processed via Stripe. Refunds are at our discretion — we do not refund per-case fees for cases that have been used.
6. Your data
You retain ownership of all data you input into the Service. We will not access your case data except as necessary to provide the Service or as required by law. See our Privacy Policy for details on data handling.
7. Data accuracy
We make reasonable efforts to keep regulatory data (AWE tables, RBA rates, MEC values, tax brackets, etc.) current and accurate. However, we do not guarantee the accuracy of any data or calculations. You should independently verify all regulatory data and calculation outputs before relying on them in legal proceedings.
8. Availability
We aim for high availability but do not guarantee uninterrupted service. Planned maintenance will be communicated in advance where possible. We are not liable for any loss resulting from service interruptions.
9. Limitation of liability
To the maximum extent permitted by law, our total liability for any claim arising from or related to the Service is limited to the fees you have paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, or punitive damages.
10. Termination
You may cancel at any time. Upon cancellation, you retain read-only access to your data for 90 days. We may terminate your account for violation of these Terms.
11. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated via email to registered users at least 30 days before taking effect.
12. Governing law
These Terms are governed by the laws of New South Wales, Australia. Any disputes will be resolved in the courts of New South Wales.
